Michigan Legal Requirements for Family Law

Michigan family law is governed primarily by the Michigan Compiled Laws, and several statutes bear directly on cases we handle in Rochester Hills and across Oakland County.

Divorce residency. Under MCL 552.9, at least one spouse must have been a Michigan resident for 180 days immediately before filing. Additionally, the filing party must have resided in the county where the case is filed for at least 10 days. Oakland County residents filing for divorce in the Sixth Circuit Court must meet both requirements.

Waiting periods. Michigan imposes a mandatory waiting period of 60 days for divorces without minor children and 180 days when minor children are involved. There is no waiving the 180-day period except under very limited circumstances. This is often longer than clients expect, and it’s important to understand it upfront. Child custody standards. Under MCL 722.23, Michigan courts evaluate 12 statutory best interest factors when making custody determinations. Spousal support. Michigan does not use a formula for calculating alimony. The Michigan Courts consider factors including the length of the marriage, each spouse’s earning capacity, age, health, and contributions during the marriage.

Equitable distribution. Unlike community property states, Michigan divides marital property equitably, meaning fairly but not necessarily equally.
