Going through a divorce involves legal, financial, and emotional changes. While no two cases are exactly the same, there are several common steps most people can expect. Knowing what’s ahead can help you prepare and make better decisions throughout the process.

Filing The Divorce Petition

One spouse must file a formal petition for divorce with the appropriate court. This includes basic information about the marriage, such as date of marriage, grounds for divorce, and any initial requests related to children, property, or support. The other spouse is then served with the documents and has a set period to respond.

Temporary Orders May Be Issued

In some cases, the court will issue temporary orders to cover things like child custody, support, or use of shared property while the divorce is pending. These orders remain in place until the final judgment is entered. We help clients review and request these orders when needed.

Information Gathering And Disclosures

Both spouses are required to provide full financial disclosures, including income, assets, debts, and expenses. This step is important because it forms the basis for decisions around property division, spousal support, and child-related matters. Being organized from the beginning makes this step smoother.

Negotiation And Agreement

Many divorce cases are resolved through settlement rather than trial. If both parties can reach an agreement, it may cover custody arrangements, parenting time, asset division, and financial support. This agreement is then submitted to the court for approval. We assist our clients in these negotiations to help them reach fair and practical outcomes.

Mediation Or Court Involvement

If issues remain unresolved, mediation may be required or recommended. If that still doesn’t lead to agreement, the case may move to trial, where a judge makes the final decisions. We try to understand how their divorce is affecting them, prepare our clients for each step, help them avoid common mistakes,  and represent their interests whether inside or outside the courtroom.

Final Judgment

Once all terms are resolved, the court issues a final divorce judgment. This document outlines the official terms of the divorce, including custody, division of property, and support arrangements. It is a binding court order that both parties must follow.
